Most people think of a “Last Will & Testament” when they think of a will. However there are other options available when a trust is involved. A Last Will & Testament allows the individual to establish beneficiaries (those who will receive the assets or property) as well as an executor (the person responsible for making sure the property is distributed to the beneficiaries). A pour-over will allows any remaining property outside of the trust to be transferred to the trust at the time of the death of the grantor (after it passes through probate). The pour-over will is a great resource to have as it saves time and provides reassurance for the client that their trust will continue to protect their property even after they pass. It also allows the client to have one document (the trust the will pours over to) that controls the disposition of all their property rather than having to change multiple documents.
